Preserve Rules

As a guest of Dogwood Creek Hunting Preserve, Inc. (the “Preserve”), I understand that acceptance of and strict adherence to the following preserve rules are necessary prior to scheduling a hunt or entering the property is a necessary precondition to participating in the activities offered at the Preserve. Further, I understand that I am electronically signing this form. I attest and certify that the information provided is true and accurate. I understand that my electronic signature has the same legal effect and can be enforced in the same way as a handwritten signature.  I fully understand that this is a binding agreement and I attest that I have had the opportunity to have an attorney of my choosing review these terms.

I have read and agree to the above and following terms and conditions in full without reservation or objection:

  1. While on the Preserve, I shall comply with all Game and Fish laws and regulations of the United States of America, the State of Georgia and all other appropriate governmental authorities.

  2. While on Dogwood Creek Hunting Preserve, I shall (1) observe the rules of safe gun handling; (b) never shoot in the direction of any people, or buildings; (c) use proper care in crossing fences and (d) not use alcohol or drugs.

  3. I shall not arrive at Dogwood Creek Hunting Preserve premises under the influence of alcohol or drugs.

  4. PURCHASE OF A SCHEDULED HUNT AND AMMENITIES IS NON-REFUNDABLE. THE PRESERVE AGREES THAT IT WILL MAKE COMMERCIALLY REASONABLE EFFORTS TO RESCHEDULE PAID HUNTS IF CANCELLED BUT I AGREE THAT RESCHEDULING MUST OCCUR WITHIN 24 MONTHS OF THE DATE OF THE ORIGINAL CANCELLED HUNT.

  5. I shall exercise due care not to cause or permit damage or injury to fences, crops, trees, or equipment and shall not commit or permit waste and damage or injury, and shall not conduct or permit any illegal activity on the Premises.

  6. I UNDERSTAND THAT I AM ALLOWED FOUR HUNTERS MAXIMUM PER HUNT.

  7. SHOTGUNS THAT BREAK OPEN,  OVER AND UNDER, SINGLE SHOT, OR SIDE­ BY-SIDE ARE STRONGLY ENCOURAGED. SEMI-AUTO GUNS ARE ALLOWED BUT THE BREACH MUST REMAIN OPEN AND UNLOADED UNTIL INSTRUCTED BY THE GUIDE TO LOAD AND AN APPROPRIATE PLUG LIMITING THE NUMBER OF SHOTSHELLS TO TWO MUST BE INSTALLED.

  8. A VALID GEORGIA HUNTING LICENSE AND A PRESERVE LICENSE ARE REQUIRED.

  9. SHOOTERS MUST BE 16 YEARS OF AGE OR OLDER. THOSE UNDER 16 MUST BE ACCOMPANIED BY AN ADULT.

  10. ALL HUNTERS ARE REQUIRED TO SIGN A "RELEASE OF LIABILITY, HOLD HARMLESS, AND INDEMNIFICATION" AGREEMENT AND RECEIVE A PRE-HUNT SAFETY BRIEFING. (SEE RELEASE OF LIABILITY, HOLD HARMLESS, AND INDEMNIFICATION AGREEMENT BELOW)

  11. HUNTERS MUST WEAR A "HUNTER ORANGE" VEST/COAT/SHIRT. A "HUNTER ORANGE" HAT IS RECOMMENDED.  ALSO, EYE/EAR PROTECTION IS RECOMMENDED.

  12. 7 1/2 SHOT SHELLS AND ABOVE ONLY.

  13. FIRST VISIT HUNTERS WILL BE REQUIRED TO SHOOT AT THE CLAY RANGE, PRIOR TO THE HUNT, SIX CLAYS AT NO CHARGE. THIS ALLOWS THE GUIDE TO MAKE SURE THAT THE HUNTER HANDLES HIS/HER GUN PROPERLY AND IS FAMILIAR WITH THE OPERATION OF THE GUN.

  14. AT ANY TIME, A GUIDE DEEMS THE HUNTER UNSAFE, THE HUNT WILL BE ENDED IMMEDIATELY, WITH  NO REFUND.

  15. NEVER SHOOT LOW FLYING BIRDS- SEE THE SKY/HORIZON BEFORE TAKING A BIRD.

  16. NEVER SHOOT BIRDS THAT FLY BEHIND A GUIDE OR OTHER HUNTERS- "NO BACK DOOR SHOTS".

  17. NEVER TURN INWARD TOWARDS A GUIDE OR ANOTHER HUNTER TO TAKE A SHOT.

  18. NEVER SHOOT OVER THE  HEAD OF THE GUIDE OR ANOTHER HUNTER.

  19. KEEP GUNS BROKEN DOWN OR BREACH OPEN AND UNLOADED WHEN APPROACHING A DOG ON POINT.

  20. KEEP GUN SAFETY "ON" UNTIL THE FLUSH OR UNTIL DIRECTED BY THE GUIDE.

  21. HUNTER(S) THAT SHOOT A DOG WILL BE RESPONSIBLE FOR ALL DOCTOR OR VETERINARIAN COSTS. IF THE DOG SHOULD DIE DUE TO BEING SHOT BY A HUNTER OR HUNTERS, THE HUNTER OR HUNTERS AGREE TO PAY THE OWNER OF THE DOG $6,000.00.

  22. NEVER CROSS PRESERVE BOUNDARY LINES TO CHASE OR RETRIEVE A BIRD.

  23. NO LOADED GUNS IN VEHICLES, PARKING AREAS, MEETING AREAS, OR BUILDINGS.

  24. ALL VEHICLES MUST PARK IN DESIGNATED AREAS. ALL VEHICLES MUST STAY ON DESIGNATED ROADS WITH NO EXCEPTIONS.

  25. DRINKING OF ALCOHOL WILL NOT BE PERMITTED PRIOR TO OR DURING THE HUNT.

  26. A DAILY LIMIT OF 12 BIRDS FOR A HALF DAY HUNT AND 24 BIRDS FOR A FULL DAY HUNT PER HUNTER IS INCLUDED IN THE HUNT PRICE. NO SHARING OF BIRDS BETWEEN HUNTERS IS ALLOWED.  ADDITIONAL BIRDS CAN BE PURCHASED AND SET UPON AGREEMENT WITH THE PRESERVE.

  27. START TIME. FAILURE TO ADHERE TO THIS TIME FRAME WILL RESULT IN THE LOSS OF AN ALLOTTED HUNT(S).

  28. I WILL NOT DISRESPECT, CURSE, HARASS, OR MISTREAT PRESERVE EMPLOYEES OR CONTRACTORS. IF I DO SO, I UNDERSTAND THAT I WILL BE EJECTED FROM THE PROPERTY WITHOUT A REFUND OF ANY KIND.

  8. A VALID GEORGIA HUNTING LICENSE AND A PRESERVE LICENSE ARE REQUIRED.

  9. SHOOTERS MUST BE 16 YEARS OF AGE OR OLDER. THOSE UNDER 16 MUST BE ACCOMPANIED BY AN ADULT.

  10. ALL HUNTERS ARE REQUIRED TO SIGN A "RELEASE OF LIABILITY, HOLD HARMLESS, AND INDEMNIFICATION" AGREEMENT AND RECEIVE A PRE-HUNT SAFETY BRIEFING. (SEE RELEASE OF LIABILITY, HOLD HARMLESS, AND INDEMNIFICATION AGREEMENT BELOW)

  11. HUNTERS MUST WEAR A "HUNTER ORANGE" VEST/COAT/SHIRT. A "HUNTER ORANGE" HAT IS RECOMMENDED.  ALSO, EYE/EAR PROTECTION IS RECOMMENDED.

  12. 7 1/2 SHOT SHELLS AND ABOVE ONLY.

  21. HUNTER(S) THAT SHOOT A DOG WILL BE RESPONSIBLE FOR ALL DOCTOR OR VETERINARIAN COSTS. IF THE DOG SHOULD DIE DUE TO BEING SHOT BY A HUNTER OR HUNTERS, THE HUNTER OR HUNTERS AGREE TO PAY THE OWNER OF THE DOG $6,000.00.

  23. NO LOADED GUNS IN VEHICLES, PARKING AREAS, MEETING AREAS, OR BUILDINGS.

  24. ALL VEHICLES MUST PARK IN DESIGNATED AREAS. ALL VEHICLES MUST STAY ON DESIGNATED ROADS WITH NO EXCEPTIONS.

RELEASE OF LIABILITY, HOLD HARMLESS, AND INDEMNIFICATION AGREEMENT

RELEASE OF LIABILITY, HOLD HARMLESS, AND INDEMNIFICATION AGREEMENT I understand that during my participation in this hunt that I may be exposed to a variety of hazards and risks, foreseen or unforeseen which are inherent in each Hunt and cannot be eliminated without destroying the unique character of the Hunt.  I agree that it is not a necessity for me to hunt or shoot and that I do so for my own personal pleasure and entertainment. These inherent risks include but are not limited to, the dangers of serious personal injury, property damage, and catastrophic injury from the exposure to firearms, insects, wildlife, such as snakes, fallen trees, animal holes, and many other natural risks. I attest and affirm that neither the Dogwood Creek Hunting Preserve, Inc. (hereinafter, the “Preserve”) nor any of its employees, contractors, agents or representatives have tried to contradict or minimize my understanding of these risks. I know that injuries and damages can occur by natural causes or activities of other persons, including, tripping, stumbling, falling, or slipping. I understand that such injuries and damages are involved in hunting and I appreciate and understand that I have to exercise more care for my own person and for others around me in the face of such hazards. I assume full responsibility for staying away from obvious hazards and all objects that could harm me, whether natural or manmade which are incidental to the operation of a hunting preserve and unattended country property.  The Hunt officially begins and ends with entering and leaving Dogwood Creek Hunting Preserve at 15171/15263 Ga Hwy 74, Culloden, Georgia.  I understand that I am personally responsible for all risks associated with travel including but not limited to carpooling, transportation, or transit to and from the disclosed location.In consideration for the right to enter the premises of the Preserve, I hereby release and agree to protect, indemnify and hold harmless Dogwood Creek Hunting Preserve, Inc. and its owners and respective agents, employees, board members, officers, and assigns from and against any and all claims, demands, causes of action and damages, including attorneys’ fees resulting from any accident, incident, or occurrence arising out of, incidental to or in any way resulting from the use of the Preserve premises and all improvements thereon.  This release applies during the time I am permitted on the Preserve.  I hereby further covenant and agree that I, my heirs, successors and assigns will not make any claim or institute any suite or action at law or in equity against the Preserve or its owners and/or their heirs, and/or the Preserve’s respective agents, employees, board members, officers, representatives, successors, or assigns.  This Agreement is intended to be as broad and inclusive as is permitted by law.  If any provision or any part of any provision of the Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected and shall remain valid and fully enforceable. I have read this document in its entirety and freely and voluntarily assume all risks of such injuries and damages and notwithstanding such risks.  I also agree that I have been given the right to seek an attorney’s opinion before signing this agreement, and if I have not done so, it is because I have chosen not to do so, and nothing has been said to me verbally or implied in any way, that an attorney’s counsel is not necessary.  I know attorneys should be consulted before contracts are signed, and this is a contract.  I agree to participate in the hunt.  To the fullest extend allowed by law, I agree to WAIVE, DISCHARGE CLAIMS, RELEASE, AND INDEMNIFY FROM AND AGAINST LIABILITY Dogwood Creek Hunting Preserve, Inc., its owners and their heirs, and its officers, respective agents, employees, board members, representatives, successors, or assigns (collectively “Indemnified Parties”) of any and all liability even if caused by the negligence of an Indemnified Party or Indemnified Parties.
